Law No. 66 of 1998
Repealing the Provisions Preventing Certain Public Authorities and Public Corporations from Being Subject to the Oversight of the State Audit Bureau or the Public Tenders Law

Article 1

Every provision contained in any of the laws establishing or regulating the public authorities and public corporations with annexed and independent budgets which prevents their activities from being subject to the prior oversight of the State Audit Bureau provided for in Law No. 30 of 1964, or to the provisions of the Public Tenders Law No. 37 of 1964, both referred to above, is hereby repealed.
Excepted from the provisions of the preceding paragraph are the Central Bank of Kuwait, as well as oil and oil derivatives sales operations and the investment operations carried out by the public corporations and authorities that were not subject to the prior oversight of the State Audit Bureau or to the provisions of the Central Public Tenders Law before this Law came into force, provided that this does not conflict with the provisions of Law No. (1) of 1993 on the Protection of Public Funds.

Article 2

The President of the State Audit Bureau shall, after obtaining the opinion of the Competent Minister, issue the decisions necessary for the Bureau to exercise the prior oversight provided for in Law No. 30 of 1964 referred to above, in a manner consistent with the nature of the activity of each of the entities subject to this oversight, and in a manner that serves the public interest and ensures the circulation of information in a manner that preserves its confidentiality.
The President of the Bureau may, in the cases he deems appropriate, be satisfied with the entity notifying the Bureau of the contract or commitment within a time limit he shall specify, without prejudice to the Bureau’s right of subsequent oversight of the contract or commitment.

Article 3

The Ministers, each within his own competence, shall implement this Law.
